Following is an update of our previous IMI "Certificate of origin for WTO non-member countries".

As of August 12, 1999, the Government of Argentina has established that a certificate of origin is required, for customs clearance purposes, for all imports from WTO non-member countries.

The following items are exempted from this requirement.

a) Components and accessories classified under chapters 84 and 85 of the Harmonized System, being essential parts of data processing equipment or telecommunications equipment.

b) Components and accessories that form part of an integral kit, with disk units as the principal element.

Imports of items a and b will have to comply with the following requirements, in order to be exempted:

  • Components and accessories must be manufactured in WTO non-member countries.
  • Components and accessories must be classified under the corresponding Harmonized System number, even if they are an integral part of the above mentioned equipment.
  • The commercial invoice must show the equipment as a whole/indivisible unit, which includes those components and accessories.
  • The equipment must be sold as a whole/indivisible unit.

c) Products classified under chapter 27 of the Harmonized System.

d) Raw materials, parts, components and accessories destined to production activities in the Special Customs Area of Tierra del Fuego, except for those affected by antidumping or protection measures.

This measure also applies to goods coming from Free Trade Zones and Special Customs Areas.

Imports of products manufactured in a WTO non-member country, but proceeding from a third country, must follow the procedure set forth below:

  • The Argentine Customs require the presentation of a certificate of origin, issued in the manufacturing country, legalized by the Argentine Consulate located in the re-exporting country.

  • The following information must be indicated on the back of the certificate of origin:
  • name of the Argentine importer
  • date and number of the commercial invoice issued by the exporter/manufacturer in the country of origin.
  • description of the product (including quantity) re-exported to Argentina

  • The commercial invoice, issued by the re-exporter, must show the certificate of origin number.

The Argentine importer can present a warranty if the certificate of origin is not available at the time of customs clearance. The importer will have 10 days to comply with the required documentation.
