AdvaMed's Code of Ethics Logo Supporters Program

AdvaMed has developed a distinctive Logo for use by medical technology manufacturers that adhere to the Association's Code of Ethics on Interactions with Health Care Professionals ("AdvaMed Code"). The purpose of this Logo is to promote awareness among the industry, health care providers and the general public of the AdvaMed Code and to provide a visible symbol of medical technology companies' commitment to the ethical standards embodied by the Code.

Companies wishing to make use of the Logo must sign a nonexclusive License Agreement. The License Agreement requires companies to self-certify that they meet eight steps or elements in their implementation of the AdvaMed Code of Ethics. These eight elements align with the HHS Office of the Inspector General Compliance Program Effectiveness Guidance and outline specific programs and processes firms must maintain to ensure effective compliance with the Code.

Licensees may use the Code of Ethics Logo on print or electronic materials to represent their commitment to effective compliance programming and ethical interactions with health care providers. For example, licensees may print the logo on annual reports, promotional material, business cards, stationery and conference banners and signs. The logo may not be used in a manner or associated with text that implies that AdvaMed has endorsed or approved a licensee's products, technology or individual compliance plan or practices.

The term of the License is one (1) year from the Effective Date, as stated on the Agreement and there is a $300 royalty fee. The Agreement must be signed by Chief Executive Officer (CEO) of the legal entity seeking the license. On receipt of a signed License Agreement and royalty fee, AdvaMed will provide a License Acceptance letter, a copy of the Logo License Graphic Standards and electronic copies of the Logo.

Companies are urged to review the terms and conditions of the License Agreement carefully. A signed License Agreement reflects a company's certification regarding certain elements of their compliance program and commitment to compliance. Companies may wish to consult with their legal counsel regarding the implications of certification.
